An uncontested divorce is cost efficient and easier on the family than a contested divorce.  While the public policy of Virginia favors marriage and disfavors divorces, sometimes people are not meant to remain together.  Individuals can save time, money, and peace of mind by pursuing an uncontested divorce.

The steps for an uncontested divorce are easy.  First, parties should contact an attorney to prepare a separation agreement, which resolves all the issues in the divorce.  Second, if there are no minor children, the parties can file a complaint for divorce after a six month separation.  If the parties have minor children, the husband and wife must be separated for 12 months before filing the complaint for divorce.  Third, the parties can obtain the divorce by submitting affidavits to the court, along with all required paperwork or schedule a hearing before the court.  In any case a decree of divorce must be submitted to be entered by the Court.
